1. Introduction and General Definitions
1.1 General

Welcome to the “Blue & White Blueberries” website (hereinafter: the “Website”), which operates as an online store for the sale of fresh berries and related products.
The Website is operated by Blue & White Blueberries Ltd. (hereinafter: the “Company” and/or the “Website Management”), from the address: Emek Huron Moshav, Israel.

1.3 Acceptance of the Terms

Browsing the Website and/or making a purchase through it constitutes full, absolute, and unconditional acceptance of all provisions of these Terms and Conditions.
If you do not agree to these Terms, please refrain from using the Website.

Note: These Terms are written in the masculine form for convenience only and apply equally to all genders.

1.4 Amendments

The Company reserves the right to update or modify these Terms at any time, without prior notice.
The binding version shall be the most recent version published on the Website.

2. Eligibility to Make Purchases

Age: Purchases on the Website are permitted only to individuals aged 18 or older who are legally competent to enter into binding agreements.

Payment Methods: The user must hold a valid Israeli credit card or another payment method approved by the Website Management.

Accuracy of Details: The customer is responsible for providing accurate and complete personal details (full name, address, phone number, and email). Providing incorrect details may result in delays in delivery or cancellation of the transaction.

3. Product Orders, Prices and Transaction Approval (Authorization Hold Mechanism)

Product Availability: All sales on the Website are subject to available inventory of berries.

Prices: All prices include VAT as required by law, unless stated otherwise.

3.4 Transaction Hold and Final Approval (Manual Approval)

Authorization Hold: Upon placing an order, an authorization hold (credit frame capture) is applied to the customer’s credit card, but no immediate charge is made.

Manual Approval: Processing and final approval of the order are subject to manual approval by the Website Management (Blue & White Blueberries Ltd.).

Final Approval and Charge: The actual charge will be made only after the Company has manually approved the order. A final confirmation notice will be sent to the customer by email or SMS after approval.

Order Rejection: If the Company does not approve the order for any reason whatsoever (including lack of inventory, logistical issues, or delivery area limitations), the transaction will be cancelled and the authorization hold will be released. The Company shall not be liable for any damage resulting from non-approval or cancellation of the order.

4. Supply and Delivery (Perishable Food Products)

Order Processing Start: Order processing and delivery times begin only after receipt of the Company’s final approval, as stated in Section 3.4.

Delivery Responsibility: Berries are sensitive, perishable food products requiring immediate refrigeration. Deliveries are carried out using temperature-controlled methods.

Delivery Times: Estimated delivery times will be displayed at checkout. The Company shall not be liable for delays caused by force majeure or circumstances beyond its control.

Customer Availability: The customer undertakes to be present, or ensure the presence of a representative, at the specified delivery address during the delivery time window. If the delivery cannot be completed and the products cannot be left in a safe and suitable location, the products may spoil, and the customer will be charged the full order amount.

5. Cancellation and Refund Policy
5.1 Cancellation of Perishable Food Purchases

In accordance with the Consumer Protection Law, purchases of fresh berries (blueberries) cannot be cancelled once the order has received final approval and preparation or dispatch has begun, due to their nature as short-shelf-life perishable food products.

5.2 Cancellation Before Shipment

Cancellation of an order prior to final approval (Section 3.4) or prior to dispatch for delivery is possible by written notice and will be subject to cancellation fees as prescribed by law (up to 5% of the transaction amount or NIS 100, whichever is lower).

5.3 Receipt of a Defective Product

If the blueberries arrive in an unusually defective condition, the customer must notify customer service within 3 hours of receiving the delivery and provide clear photographic documentation of the defect.
The Company will review the claim and will act accordingly (refund or replacement shipment) if it is proven that the defect occurred under the Company’s responsibility.

6. Privacy Policy and Data Security

Database: Personal information collected (name, address, phone number, email) is stored in the Company’s database and is used solely for order processing and customer relationship management.

Security: Credit card details are processed by secure external payment providers and are not stored on the Company’s systems.

Direct Marketing: The user agrees to receive promotional communications (direct marketing) by email or SMS, unless they choose to unsubscribe via the removal mechanism included in the messages or by contacting info@bwberry.com

Cookies: The Website uses cookies, as detailed in the Company’s separate Privacy Policy.

7. Intellectual Property

All intellectual property rights on the “Blue & White Blueberries” Website, including trademarks, graphic design, images, texts, and website code, are the exclusive property of Blue & White Blueberries Ltd.
Any use, copying, reproduction, or distribution of any Website content without prior written consent from the Company is strictly prohibited.

8. Governing Law and Jurisdiction

Governing Law: These Terms and any matter arising therefrom shall be governed exclusively by the laws of the State of Israel.

Exclusive Jurisdiction: Exclusive jurisdiction over any dispute related to these Terms shall be vested in the competent courts of Netanya, Israel.
